These Terms of Service ("Terms") govern your access to and use of The Bestseller AI, including the website at thebestsellerai.com and all related services, features, and content (collectively, the "Service"). The Service is operated by Everlight Solutions LLC ("Company", "we", "us", or "our"). By creating an account, purchasing, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements and that the information you provide is accurate and complete.

2. The Service

The Service uses artificial intelligence to help you generate written works, cover art, illustrations, audiobooks, translations, and related materials ("Output"), and provides tools and assistance to help you publish your Output on third-party platforms such as Amazon Kindle Direct Publishing ("KDP"). We may add, modify, or discontinue features at any time.

3. Accounts

You are responsible for safeguarding your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

4. Plans, Credits & Billing

The Service is offered through subscription plans and credit packs. Credits are consumed when you generate books, addons, or other Output, at the rates shown in the app. Subscriptions renew automatically at the end of each billing period until cancelled. Payments are processed by our payment provider, Stripe; we do not store full payment card details. Prices are stated in U.S. dollars unless otherwise indicated and exclude any applicable taxes.

You may cancel your subscription at any time from your account settings; cancellation stops future renewals. Credits may expire as described in the app.

5. Refunds & Money-Back Guarantee

We offer a 14-day money-back guarantee on eligible first-time subscription purchases: if you are not satisfied, contact us within 14 days of the purchase date at contact@thebestsellerai.com to request a refund of that purchase. Except where required by law or expressly stated, credit packs and consumed credits are non-refundable. Refunds are issued to the original payment method.

6. Your Content and Output

You retain ownership of the inputs you provide and, to the maximum extent permitted by law and subject to your compliance with these Terms, of the Output you generate using the Service. You grant us a limited license to process your inputs and Output solely to operate, secure, and improve the Service.

You are solely responsible for your inputs and Output, including ensuring you have the rights to any material you submit and that your Output and its publication comply with all applicable laws and third-party rules (including Amazon KDP's content and quality policies). AI-generated Output may be inaccurate, may resemble other works, and is provided without any warranty of originality, fitness, or non-infringement.

7. Acceptable Use

You agree not to use the Service to create or distribute content that is unlawful, infringing, defamatory, hateful, sexually exploitative of minors, or that violates the rights of others; to reverse engineer or disrupt the Service; to resell the Service without authorization; or to generate content that violates the policies of platforms on which you publish.

8. Third-Party Services

The Service integrates with third parties (including Stripe for payments, AI model providers, storage providers, and publishing platforms such as Amazon KDP). We are not affiliated with, and do not control, Amazon or other third-party platforms; your use of them is governed by their own terms. We are not responsible for third-party services.

9. No Earnings Guarantee

We make no guarantee that any book or Output created with the Service will be accepted by any platform, will sell, or will generate any income. Any examples or figures are illustrative and not a promise of results.

10. Disclaimers & Limitation of Liability

The Service and Output are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. To the maximum extent permitted by law, Everlight Solutions LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues; and our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless Everlight Solutions LLC and its officers, employees, and agents from any claims, damages, or expenses arising out of your use of the Service, your Output, or your violation of these Terms or any law or third-party right.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service. Provisions that by their nature should survive termination will survive.

13. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. The exclusive venue for any dispute not subject to arbitration or small-claims court will be the state or federal courts located in Wyoming.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
